Terms of Service

Welcome to Hurdle. These Terms of Service ("Terms") govern your access to and use of the Hurdle platform, including our website at gohurdle.com, mobile applications, and related services (collectively, the "Service") provided by Hurdle Labs, LLC ("Hurdle," "we," "us," or "our").
Please read these Terms carefully before using our Service. By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
If you are using the Service on behalf of an organization (such as a sports league, club, or team), you represent and warrant that you have authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.
1. Description of Service
Hurdle provides a software platform designed for youth sports organizations to manage their operations, including but not limited to:
- Program registration and enrollment management
- Online payment processing
- Member and participant management
- Communication tools (email, SMS, in-app messaging)
- Scheduling and calendar management
- Team formation and roster management
- Digital waivers and document management
- Analytics and reporting
- AI-powered features and assistance
2. Eligibility and Account Registration
2.1 Eligibility
You must be at least 18 years old to create an organization account on Hurdle. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. Parents and guardians may create accounts to manage their family's registrations and communications.
2.2 Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
2.3 Organization Accounts
Organization administrators are responsible for managing access to their organization's account, including inviting and removing staff members, and ensuring all users comply with these Terms. Organization administrators are responsible for the content uploaded and activities conducted through their organization's account.
3. Fees and Payment
3.1 Subscription Fees
Access to the Service requires a paid subscription. Current pricing is available at gohurdle.com/pricing. We offer monthly and annual subscription options. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your plan). All fees are non-refundable except as expressly stated in these Terms or required by law.
3.2 Payment Processing
Payment processing is provided by Stripe, Inc. By using our payment features, you also agree to Stripe's Terms of Service. Organizations using Hurdle to collect payments from their members must set up a Stripe Connect account. Hurdle does not charge platform fees or transaction fees on payments you collect—you pay only Stripe's standard processing fees.
3.3 Free Trial
We may offer a free trial period. At the end of the trial, you will be required to select a paid plan to continue using the Service. We will not automatically charge you without your explicit consent to begin a paid subscription.
3.4 Price Changes
We reserve the right to modify our pricing. Price changes will be communicated at least 30 days in advance and will take effect at the start of your next billing cycle. Your continued use of the Service after price changes constitutes acceptance of the new pricing.
4. SMS and Communication Terms
4.1 SMS Notifications
Our Service includes SMS notification features. By providing a phone number and opting in to receive SMS messages, you consent to receive text messages from Hurdle and from organizations using our platform for transactional purposes, including:
- Registration confirmations and updates
- Payment receipts and reminders
- Schedule reminders and changes
- Program announcements and updates
- Event notifications
Message frequency varies based on your activity and the organizations you interact with. Message and data rates may apply depending on your mobile carrier plan.
4.2 Opting Out
You may opt out of SMS notifications at any time by:
- Replying STOP to any message
- Updating your notification preferences in your account settings
- Contacting us at support@gohurdle.com
Note that opting out of SMS may affect your ability to receive important transactional notifications. You may still receive essential service-related messages as permitted by law.
4.3 Organization Communication Responsibilities
Organizations using Hurdle to send communications to their members are responsible for ensuring they have appropriate consent from recipients and comply with all applicable communication laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and similar regulations. Organizations agree not to use our communication tools to send spam, unsolicited marketing messages, or any content that violates applicable laws.
5. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Violate any applicable federal, state, local, or international law or regulation
- Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Impersonate any person or entity, or falsely state or misrepresent your affiliation
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any part of the Service or other accounts, systems, or networks
- Use any automated means (bots, scrapers, etc.) to access the Service without our express permission
- Collect or store personal data about other users without their consent
- Use the Service for any purpose that is harmful to minors
- Send spam, unsolicited bulk messages, or marketing communications to individuals who have not consented
- Upload or transmit viruses, malware, or other malicious code
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service in any manner that could damage, disable, overburden, or impair the Service
6. Youth Sports Compliance
6.1 Child Safety
Given the nature of youth sports, organizations using Hurdle have heightened responsibilities for child safety. Organizations agree to:
- Comply with all applicable child protection laws and regulations
- Obtain appropriate parental consent for minor participants
- Implement appropriate background check and screening procedures for coaches and volunteers as required by law and best practices
- Handle participant medical information with appropriate care and confidentiality
- Report any suspected child abuse or neglect as required by applicable law
6.2 COPPA Compliance
Organizations collecting information from children under 13 through the Service must comply with the Children's Online Privacy Protection Act (COPPA). By using the Service to collect such information, you represent that you have obtained verifiable parental consent as required by COPPA. Hurdle provides tools to help facilitate parental consent but does not independently verify parental identity. Organizations remain responsible for COPPA compliance.
7. User Content
7.1 Your Content
You retain ownership of content you upload, post, or transmit through the Service ("User Content"). By submitting User Content, you grant Hurdle a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display your User Content solely for the purpose of providing and improving the Service.
7.2 Content Responsibilities
You are solely responsible for your User Content and represent that:
- You own or have the necessary rights to use and authorize the use of your User Content
- Your User Content does not violate any third party's intellectual property, privacy, or other rights
- Your User Content complies with these Terms and all applicable laws
7.3 Content Removal
We reserve the right to remove or disable access to any User Content that we believe violates these Terms, without prior notice. We are not obligated to monitor User Content but may do so at our discretion.
8. Intellectual Property
8.1 Our Intellectual Property
The Service and its original content, features, and functionality (excluding User Content) are and will remain the exclusive property of Hurdle Labs, LLC and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.
8.2 Feedback
If you provide us with feedback, suggestions, or ideas about the Service ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such Feedback into the Service without any obligation to you.
9. Third-Party Services
The Service may integrate with or contain links to third-party services, including payment processors, calendar applications, and other tools. These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services. Your use of third-party services is at your own risk.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Results obtained from using the Service will be accurate or reliable
- Any errors in the Service will be corrected
- The Service will meet your specific requirements
You acknowledge that Hurdle is a software platform and does not provide coaching, medical, or legal advice. Organizations are responsible for their own operational decisions, safety protocols, and compliance with applicable laws and regulations.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HURDLE LABS, LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Hurdle Labs, LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party right, including any intellectual property, privacy, or publicity right; (d) your User Content; or (e) any claim that your use of the Service caused damage to a third party. This indemnification obligation will survive termination of these Terms and your use of the Service.
13. Termination
13.1 Termination by You
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will be effective at the end of your current billing period. You will continue to have access to the Service until then. We do not provide refunds for partial billing periods.
13.2 Termination by Us
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if:
- You breach these Terms
- Your payment fails and is not remedied within a reasonable period
- We are required to do so by law
- We discontinue the Service (with reasonable notice)
13.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may retain certain data as required by law or for legitimate business purposes. You may request export of your data prior to termination. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
14. Dispute Resolution
14.1 Informal Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@gohurdle.com. We will try to resolve the dispute informally within 60 days.
14.2 Arbitration Agreement
If we cannot resolve the dispute informally, you and Hurdle agree to resolve any claims relating to these Terms or the Service through final and binding arbitration, except that either party may bring suit in court for injunctive relief for intellectual property infringement or other misuse of intellectual property rights.
14.3 Class Action Waiver
YOU AND HURDLE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
14.4 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a new effective date, and for significant changes, by email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
16. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hurdle regarding the Service and supersede all prior agreements.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
- Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.
- Force Majeure: We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, or internet service failures.
